Case Background

Below are six documents that provide comprehensive background on the injustice perpetrated on Jude Shao. All of the information provided on this website was developed using official trial records of the Shanghai No. 1 Intermediate Court, accounting records of China Business Ventures (CBV) recovered from the San Francisco office as well as analysis of those source documents by legal and accounting experts. Jude Shao Case Summary

The Case Summary reviews key points about Jude's case, including violations of Chinese law due process during the trial and subsequent appeals. The White Paper provides more comprehensive details of Jude's case, including errors in the "Judicial Accounting Audit Report" which was created by the Shanghai Police, and finally the exculpatory evidence that has been developed by Jude Shao, but that the Shanghai Courts refused to review.

Experts' Report

This document was produced by six of the most respected Chinese Legal scholars in Beijing. After reviewing Jude's case they concluded that there was insufficient evidence to convict Jude and that he deserves a retrial. This is independent corroboration of what Jude and his supporters have been saying for over five years!

Audit Report Supporting Conclusions of Experts' Report

The "Experts' Report" on Jude's case, listed above, concluded that the evidence did not support the conviction and Jude deserved a re-trial. They also concluded that if Jude had indeed made the three VAT payments submitted as supplemental evidence (which at the time they could not verify), not only should there be a retrial, but Jude would be innocent on all counts! In March of 2004 an accounting firm was retained to confirm whether these payments were made, and the audit report concluded that in fact that Jude did pay all the required VAT. This is further evidence that the convictions are incorrect.

Application for Medical Parole

The stress of being unjustly imprisoned has taken a toll on Jude’s health and he now has a heart condition that Prison Doctors are unable to treat. Consequently Jude’s family has filed an Application for Medical Parole. There has been no response from the Chinese Government.

Notice of Rejection of Appeal

After a three-year wait, on January 31st 2005 Jude Shao received a Notice of Rejection of Appeal from the Supreme People's Court. The rejection was dated November 22, 2004 and no explanation was given for the discrepancy in dates. The Supreme People's Court opinion is arbitrary and selective in its interpretation of the facts. The reasoning is faulty, and the court has not directly addressed the factual disputes and infirmities of the case raised in Jude's petition. This decision reinforces that the Chinese court system does not provide any protection for those wrongly prosecuted.  See the Congressional-Executive Commission on China's analysis on the decision here.
